Fits approx. US 8? Like new, only tried on, but do have minor factory defects like glue near sole, scallops not being cut out all the way

Ithink they are size 40 but it isn't marked anywhere I see, I usually wear size 8 and they seem about right in length but maybe a little snug in the width? There's something odd about the fit which is why I'm selling
